These Terms and Conditions ("Terms") govern your access to any and all services offered by Akshara Entertainment Network (M) Sdn Bhd, owner of a digital radio service, available through our mobile application and website called Sama Sama Oye!, and any other platforms we provide or have links to in our app or website such as, but not excluding, our social media accounts, and any other offerings in future date, and constitutes a legally binding agreement between you and Akshara Entertainment Network (M) Sdn Bhd.

By accessing or using our services, you confirm that you've read, understood, and agree to be bound by these Terms and our Privacy Policy. If you don't agree with any part of these Terms, please do not use our Service.

The links on the Sama Sama Oye! app and website that may take you outside the app and web, are yours to use, follow or subscribe to. We accept no responsibility for the content, accuracy or function of these links. The links are provided in good faith and Akshara Entertainment Network (M) Sdn Bhd, cannot be held responsible for any subsequent change in these links. We highly recommend that you make yourself aware of and carefully read the legal and privacy notices of all other links you visit.

1. Your Acceptance of These Terms

These Terms form a legally binding agreement between you and Akshara Entertainment Network (M) Sdn Bhd, a company incorporated in Malaysia. We may update or change these Terms at any time without prior notice. Your continued use of our services means you accept the new Terms. We encourage you to review these Terms regularly.

2. About Sama Sama Oye!

Sama Sama Oye! is a digital radio streaming platform via a mobile application and website, featuring for example music, talk shows, podcasts, playlists, news, cultural content, contests and more.

• Free Listener Service: Enjoy 30-day Free access to a selection of our content and features
• Sama Sama Oye! Subscriber Service: Subscription fee is charged after the 30-day Free Trial
• This service may include advertisements or other forms of promotions and monetization

Sama Sama Oye! services are also extended to social media accounts of the same name.

3. Eligibility and Account Registration

• Age Requirement: To use Sama Sama Oye! digital radio, you must be at least 15 years old. If you're under 18, you need permission from a parent or legal guardian to use the Service.
• Account Creation: To access the features and content of Sama Sama Oye! digital radio service, you must register for an account with us. When you register, you agree to:
  • Provide accurate, current, and complete information.
  • Keep your account login details (username and password) confidential.
  • Be fully responsible for all activities that happen under your account.
  • Inform us immediately if you suspect any unauthorized use of your account.

4. Sama Sama Oye! Digital Radio Subscription

• Subscription Plans: Details of our Sama Sama Oye! payment plans and pricing are clearly displayed on our app. We reserve the right to change our plans and pricing at any time.
• Billing: By subscribing, you authorize us to charge you based on your chosen payment method for the applicable subscription fees on a recurring basis (e.g., monthly, quarterly, annually) until you cancel.
• Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date.
• Group Subscriptions: If you are the Primary Account Holder (Purchaser for a group subscription plan) of more than 1 person, you will be the person to activate subscriptions of your Sub-Account Holders using the same email they use to sign up with Sama Sama Oye!
• Cancellation: You can cancel your Sama Sama Oye! subscription at any time through your account settings. Your cancellation will take effect at the end of your current billing period, and you'll still have access to the features until then. Please note that we generally do not offer refunds for partial subscription periods.
• Price Adjustments: We may change the price for Sama Sama Oye! digital radio subscription from time to time. We'll give you reasonable advance notice of any price changes. If you don't agree to the new price, you can cancel your subscription before the change takes effect.

5. Permitted Use and Restrictions

• Personal Enjoyment: Sama Sama Oye! digital radio is for your personal, non-commercial use only.
• What You CANNOT Do: You agree not to:
  • Copy, distribute, modify, display, or create derivative works from any part of Sama Sama Oye! content without our explicit written permission.
  • Use the Service for any unlawful purpose or in any way that violates Malaysian laws, including the Communications and Multimedia Act 1998 and the Content Code 2022.
  • Bypass or interfere with any security features of the Service.
  • Access or tamper with non-public areas of our Service, computer systems, or our providers' technical delivery systems.
  • Transmit any content that is indecent, vulgar, offensive, obscene, false, threatening, offensive, defamatory, or infringes on anyone else's rights.
  • Do anything that could harm, disable, overburden, or impair our servers or networks.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems.
  • Use any automated systems (like bots or spiders) to access Sama Sama Oye!

6. Content and Intellectual Property

• Our Content: All content on Sama Sama Oye! (excluding user-generated content, if applicable), including text, graphics, logos, audio, and software, belongs to Akshara Entertainment Network (M) Sdn Bhd or our licensors. It's protected by Malaysian and international copyright, trademark, and other intellectual property laws.
• Third-Party Content: Our Service may feature or link to content from third-parties (e.g., music, news, advertisements). We don't own or control this content and aren't responsible for its accuracy, legality, or any other aspect. Your use of such third-party content may be subject to their own terms.
• Your Content (if applicable): If Sama Sama Oye! allows you to upload or post content ("User Content"), you retain ownership of your User Content. However, by providing it, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display, and perform your User Content in connection with the Service. You confirm that you have all necessary rights to grant us this license. We reserve the right to remove any User Content that violates these Terms or applicable laws.

7. Your Privacy

Your privacy is very important to us. How we collect, use, and disclose your personal data is detailed in our Privacy Policy, which is part of these Terms. By using Sama Sama Oye!, you consent to our data practices as described in the Privacy Policy, in compliance with Malaysia's Personal Data Protection Act 2010 (PDPA).

8. Disclaimers and Limitation of Liability

• "As Is" Basis: Sama Sama Oye! is provided "as is" and "as available," without any warranties, express or implied. This includes, but isn't limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Service Availability: We don't guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• Limited Liability: To the fullest extent permitted by Malaysian law, neither Akshara Entertainment Network (M) Sdn Bhd, nor its affiliates, directors, employees, or licensors, will be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of or inability to use Sama Sama Oye!, even if we've been advised of the possibility of such damages. Our total liability to you for any claims related to these Terms or the Service will not exceed the amount you paid, if any, for accessing the Service in the twelve (12) months before the claim.

9. Indemnification

You agree to protect and hold harmless Akshara Entertainment Network (M) Sdn Bhd, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) that arise from:

• Your access to or use of Sama Sama Oye!
• Your violation of these Terms.
• Your infringement of any intellectual property or other rights of a third-party.
• Any User Content you provide.

10. Termination of Service

We may suspend or terminate your access to Sama Sama Oye!, in whole or in part, at any time and for any reason, including but not limited to:

• Your breach of these Terms.
• Suspected fraudulent, abusive, or illegal activity.
• Changes in our service or business operations.
• To comply with a legal obligation.

Upon termination, your right to use the Service will immediately stop.

11. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of Malaysia, without regard to its conflict of law principles.

Any dispute or claim related to these Terms or Sama Sama Oye! will first be resolved through good faith negotiations between us. If we can't reach a resolution, the dispute will be submitted to the exclusive jurisdiction of the courts of Malaysia.

12. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, make up the entire agreement between you and Akshara Entertainment Network (M) Sdn Bhd regarding Sama Sama Oye!
• Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining parts will still be fully in effect.
• Waiver: If we don't enforce any right or provision of these Terms, it doesn't mean we're waiving those rights.
• Assignment: You can't assign or transfer these Terms without our prior written consent. we, however, can assign these Terms without restriction.
